El Usuario reconoce que Latin-FLY dará estricto cumplimiento legal a los requerimientos válidos que cualquier autoridad competente le formule, en virtud de los cuales podrán existir requisitos adicionales a los establecidos en los T&C. El cumplimiento a los requerimientos en materia de datos personales estará sujeto en todo momento a lo dispuesto por nuestra política de privacidad y por la legislación vigente. En el caso de que pueda existir sospecha que un Usuario o Billetera está incumpliendo con cualquier disposición de PLD/FT, el Usuario reconoce que Latin-FLY tiene el derecho de llevar a cabo cualquier acción de revisión y/o auditoría que considere necesaria y/o conveniente, como puede ser el solicitar y recabar cualquier tipo de información o documentación necesaria, así como reportar, a nuestra entera discreción, cualquier actividad a cualquier autoridad y, en su caso, tomar cualquier medida o llevar a cabo cualquier acto contemplado implícita o explícitamente en los T&C o en la legislación aplicable, incluyendo sin limitar la suspensión temporal o permanente de cualquier Usuario y/o Billetera o del acceso a las Aplicaciones. Como parte de la implementación de nuestra política de PLD/FT, Latin-FLY se reserva el derecho de requerir cualquier información adicional, con la intención de determinar o corroborar el perfil transaccional ya sea declarado u operado del Usuario así como el origen y el destino de los fondos involucrados en las operaciones que el Usuario realice o para cualquier otro fin relacionado o conveniente y, de no recibir la información necesaria y/o satisfactoria, Latin-FLY podrá suspender o dar por terminados los Servicios y/o la relación contractual con el Usuario, incluyendo el acceso a la Plataforma. Los Fondos que el Usuario deposita, mantiene o envía a través de la Plataforma y/o mediante el uso de su Billetera podrán ser exclusivamente reintegrados en cuentas de depósito abiertas en una Entidad Financiera a nombre del Usuario, caso contrario, previa resolución legal o judicial en ese sentido, el Usuario renuncia a todos los fondos que se encontrasen en Latin-FLY conforme a lo que determinen las autoridades competentes. Latin-FLY también podrá compartir información con Entidades Financieras de acuerdo a la Ley de cada país, con el propósito de cumplir con sus obligaciones legales y/o sus responsabilidades contractuales para con el usuario. Esto en conformidad con nuestras Políticas de Privacidad y el régimen protectorio de datos personales. Latin-FLY creará interfaces de programación de aplicaciones informáticas estandarizadas (o “APIs”) que posibilitarán la conectividad y el acceso de otras Prestadores de Servicios de Cobros y Pagos, por otras Entidades Financieras y/o por terceros especializados en tecnologías de la información, con el fin de compartir diversos datos e información según se prevea en la normatividad aplicable y conforme lo prevé nuestras Políticas de Privacidad. Latin-FLY mantiene y monitorea permanentemente el nivel de riesgo del Usuario y establece límites diarios, mensuales y anuales para usar los Servicios y conforme a las cuales requiere la información que establezca de acuerdo a las circunstancias. Habiendo cumplido con los requerimientos de información y documentación establecidos, el Usuario podrá usar los Servicios con los límites de depósitos, retiros y de saldos mensuales determinados y sujeto siempre a las disposiciones de la legislación aplicable a la actividad de Latin-FLY, sin que ello exima al Usuario de entregar o actualizar la información y/o documentación que Latin-FLY, de tiempo en tiempo, solicite de acuerdo a sus políticas de control de riesgo y prevención de lavado de activos. Latin-FLY se reserva el derecho a no abrir cuentas, Usuarios a personas que a su más entera discreción no satisfagan los requisitos establecidos, o que, por cualquier otra razón, no cumplan, a juicio de Latin-FLY cualquiera de las situaciones que éste de tiempo en tiempo determine en atención a sus intereses y el cumplimiento de cualquier legislación nacional o foránea. De igual forma Latin-FLY se reserva el derecho a modificar, a su más entera discreción su política de niveles de control de riesgo y prevención de lavado de activos, ya sea para que reflejen los cambios en el poder adquisitivo de la moneda, para adaptarlos a acontecimientos de carácter nacional o internacional que generen una desproporción o simplemente como medida de protección.
